Terms and Conditions – Holiday Apartment Bergzeit Suite Obersalzberg

General Terms and Conditions (T&Cs) for Private Holiday Rental

Scope of the Terms and Conditions

(1) These General Terms and Conditions apply to contracts for the temporary rental of the holiday apartment Bergzeit Suite Obersalzberg for accommodation purposes, as well as all related services provided by the landlord.

(2) Any differing terms and conditions of the guest shall not apply unless their validity has been expressly agreed to in writing.

(3) Sub-letting or further rental, as well as use for purposes other than residential, is not permitted.

§ 1 Definitions

(1) The Landlord is the natural person named in the booking offer.

(2) The Guest is the booking person as well as all accompanying persons.

(3) The Rental Property is the holiday apartment designated in the contract.

§ 2 Booking and Formation of Contract

(1) Bookings can be made via booking platforms (e.g. Airbnb, Booking.com), through a channel manager, or directly by e-mail or telephone.

(2) The contract is concluded upon receipt of the landlord's written booking confirmation.

(3) For bookings made via third-party platforms, the respective platform's terms and conditions apply additionally, insofar as they do not contradict these T&Cs.

§ 3 Payment Terms

(1) For direct bookings: upon booking confirmation, a deposit of 30% of the total rental price is due.

(2) The remaining balance must be paid no later than 14 days before arrival.

(3) If the deposit or the remaining balance is not paid on time, the landlord is entitled to withdraw from the contract.

(4) The landlord is entitled to request a security deposit of €200. This serves to cover minor damages and will be refunded after departure provided no damages have been identified.

(5) For bookings made via booking platforms (e.g. Airbnb, Booking.com), exclusively the payment terms and deadlines agreed on those platforms apply. A security deposit ("Security Deposit", "Host Guarantee") as provided by the platform may be collected. This does not replace the guest's liability for damages to the rental property or inventory. To the extent that the platform's arrangement does not cover the actual damage, the guest remains obligated to provide full compensation to the landlord.

§ 4 Arrival and Departure

(1) Arrival is possible on the day of arrival from 5:00 PM, and departure on the day of departure by 9:00 AM.

(2) Deviations require prior arrangement and are not guaranteed.

§ 5 Condition of the Holiday Apartment

(1) The holiday apartment is handed over in a clean and orderly condition.

(2) Any defects must be reported to the landlord without delay.

(3) The guest is liable for all damages to the rental property and inventory caused by themselves, their fellow travellers, or visitors.

§ 6 Pets

Pets are not permitted.

§ 7 Use and Occupancy

(1) The apartment may only be used by the registered persons, and the maximum occupancy of 4 persons must not be exceeded.

(2) Parties or events are not permitted.

(3) In the event of significant violations of these T&Cs or the house rules, the landlord is entitled to terminate the contract without notice.

§ 8 Guest Withdrawal (Cancellation)

(1) Any cancellation must be made in writing.

(2) The following cancellation terms apply:

  • up to 6 weeks before arrival: free of charge
  • up to 4 weeks before arrival: refund of 20% of the rental price
  • less than 4 weeks before arrival: no refund

(3) The decisive point in time is when the cancellation notice is received.

§ 9 Withdrawal by the Landlord

(1) The landlord is entitled to withdraw from the contract for important reasons, in particular in the event of unforeseeable and unavoidable circumstances (e.g. damage to the apartment, illness of cleaning staff, force majeure).

(2) In such a case, any payments already made will be refunded in full. Further claims do not exist.

§ 10 Liability

(1) The landlord is only liable for intent and gross negligence.

(2) No liability is accepted for failures of utility services (e.g. electricity, water, internet) that are not the landlord's responsibility.

§ 11 Wi-Fi Use

(1) The landlord provides the guest with a Wi-Fi connection.

(2) Use is at the guest's own risk.

(3) Abusive or unlawful use is prohibited.

§ 12 House Rules and Special Obligations

(1) The house rules form part of the contract and must be observed.

(2) A strict no-smoking policy applies throughout the entire holiday apartment, including all balconies, the stairwell, and the basement (including e-cigarettes).

(3) The apartment must be left broom-clean upon departure.

(4) The basement may only be used for storing bicycles and sports equipment. No liability is accepted for loss or theft.

(5) The washing machines and dryers located in the basement are private property and must not be used.

(6) All windows and doors must be closed when leaving the apartment. This applies in particular to the roof skylights. These are equipped with automatic rain sensors; however, the guest is obligated to ensure that all windows are closed before leaving the building in order to prevent water damage or consequential damage.

§ 13 Place of Jurisdiction

To the extent permitted by law, the place of jurisdiction is the landlord's place of residence (Fürth, Bavaria).
